Nova Games reserves the right to edit these Terms and Conditions when necessary, without prior notice to you and any changes will take effect on the day they are posted. However, we aim to please customers and will ensure the customers will be informed of any changes in the Terms and Conditions. Any custom which had taken place before the change in Terms and Conditions or during the Change in Terms and Conditions will automatically be under affect of the changes which have been made.
1.Website Content
(1.1) At Nova Games we try to ensure that the content of the website is always as accurate as possible and that there are no mistakes, however we cannot guarantee that the website is free of mistakes due to certain factors including human error.
(1.2) At Nova Games we aim to ensure we are able to provide Pre-Sales on the correct date of release, however this is not always possible as many factors including supply and demand and postage can affect the date in which the customer will receive the item.
(1.3) We aim to have a wide range of products in stock so we are able to post items to the customer on the next working day, however, the availability of the items are limited and there is a rare possibility that an item may be oversold, this will mean the delivery of items may be delayed or the order can be cancelled and the customer will be refunded the full price of the item which is not in stock. However, we do aim to accurately inform our customers of item availability and any item which is out of stock will be removed from the website to avoid any confusion in relation to orders.
(1.4) Despite our best efforts at Nova Games, there is always a possibility that an item may be priced incorrectly on the website, due to the fact that prices can change due to supplier and manufacture alterations. However, at Nova Games we will keep our customers updated on their order and we will confirm or inform any customer if they have purchased any items which had been priced inaccurately on the website. Depending on the circumstances we can offer the customer the item at the amended price or we can cancel this transaction and refund the customer the full amount which they paid for the item.
(1.5) If this should happen to you or you believe the item has an obvious pricing error please do not hesitate to inform us so we can ensure we provide fair prices to you the customer. If you proceed with a transaction in which there is an item which has an obvious pricing error Nova Games are under no obligation to proceed with the order and deliver the product to you at the incorrect price, even after the order status has been confirmed. At nova Games we will try to avoid this, however, if the pricing error is obvious to you the customer and you could have identified this as a pricing error on the product we will not proceed with your order and the order status will become cancelled and the customer will be refunded the full amount which they paid for the items in the order.
(1.6) At Nova Games we believe in offering fair prices to the customer, due to pricing errors customers rarely could pay a higher price for an item than they should, however when confirming orders we look and compare prices and we confirm that the price for each item is correct. If the customer has over paid for an item we will do our best to inform them the same day in which the order has taken place and we can offer them many options. Customers can receive a refund of the amount which they overpaid. For example, if an item is priced at £20 whereas it should be £15 the customer will only be refunded the amount which they over paid which in this case would be £5. The customer can accept this refund which will be refunded to the account in which the payment was made from only or the customer can accept a Nova Games refund voucher code which they can redeem against the price of any future orders.
Nova Games therefore have the right to cancel your order if an incorrect pricing has been given on any products within our website.
(1.7) At Nova Games we aim to ensure that the images which we provide for each of the items are correct, however, on the rare occasions the image is not accurate it may be due to the fact some images are not provided for some pre-sale items and some images for products are for display purposes only. We will, however, confirm in the title and description the of the item, all the item details so you will be informed accurately which item you have selected. We do however, aim to provide the customer with accurate information and will aim to ensure that each item listing has the correct picture assigned to it to ensure there is no customer confusion.
(1.8) At Nova Games we aim to offer a high standard of service, and we aim to keep customers accurately informed on items, this is why we revise our descriptions of items and try to ensure there is a full detailed description of the item so customer can be confident in their decision to buy an item. However, despite our best efforts we cannot guarantee that the description of the item will be mistake free and we cannot guarantee that we have provided a fully detailed description of each item.
(1.9) At Nova Games we respect and value our customers feedback, this is why we introduced a product reviews system to ensure customers can find out from independent reviews, what actual consumers think about the products. All the reviews which have been left are completely independent and we accept no responsibility for the reviews or ratings which have been left for items. We do recommend that each customer should leave feedback on the items once they have purchased and received them so others can make a confident decision when buying certain products. However, we cannot guarantee the customer ratings are completely accurate and will give other customers an accurate insight into the product due to the fact the product ratings system is based only on the opinion of some consumers which will vary from person to person.
(1.10) To keep our customers informed of new and upcoming products which relate to Nova Games we try to ensure we keep an updated news/release calendar. We try to ensure we inform our customers of any new series of certain products, however, we cannot guarantee that all the information provided on the news/release calendar is correct as the manufacturers and suppliers reserve the right to change certain information for certain products including the release date.
2. Accounts
(2.1) By creating an account with Nova Games you enter into an agreement with Nova Games to completely adhere to Nova Games Terms and conditions. Nova Games have the right to cancel an account if they believe it has been misused. If you misuse your account your account will be automatically terminated.
(2.2) If Nova Games have reason to believe you are using your account for fraudulent or illegal purposes then your account will automatically be suspended and any pending orders will also be suspended until issues have been resolved. Nova Games are obliged to forward any account details to the relevant authorities if there is obvious reason to believe your account is being misused for fraudulent or illegal purposes.
(2.3) Nova Games relies on the information which you provide us with when you register an account with is, if any of the information which you have provided us with in inaccurate, then we do not accept any responsibility if the information provided to us not accurate.
(2.4) On registration of an account we require you to provide us with a valid email address, and use your real name; we need to be sure that each member is protected from fraud on our website as much as possible so we have to ensure that the billing address matches the address which the card holder is registered to. However, you can select a different dispatch address if you want.
(2.5) your payment method details will not be stored one our system database so each time you want to make a purchase you can sign in and you will have to re enter your payment method, this helps keep your details more secure and will enable you to make a payment without mistake. We at Nova Games do not accept responsibility of the actions of individuals which use our website for purchases. If a member has misused their account or they have misused another person’s details to create an account or make a purchase with Nova Games, then we are not held responsible for the actions of the individual. However, if we suspect any such activity a suspension will be put on the account and it will be further investigated by appropriate authorities.
3. Purchasing
(3.1) By purchasing from Nova Games you acknowledge that you are not purchasing any item or material which is considered to be illegal or offensive in your country of residence or in the county of residence which the items are being shipped to. Nova Games will not be held responsible if customers purchase items which breach any laws or customs which are stated in their country.
(3.2) When making purchases with Nova Games we understand that customers may not have their payment details at hand this is why we allow customers 24 hours from placing their order to complete the transaction, this will mean the items which make up your order will be reserved for you for 24 hours. Nova games can not guarantee that orders which have not been paid for within 24 hours will be reserved. Refer to (4.1), (4.2)
4. Payment
(4.1) At Nova Games we Prefer that payment for orders is made once the order has been placed, this will mean we will be able to proceed to the next stage with you order, However, customers have the option to pay at a later date, Nova Games allow customer 24hours to make the full payment on the order.
(4.2) If a customer does not complete the transaction by making payment within 24 hours of placing the order then Nova Games will have no other choice than to automatically cancel your order. However, within the first 12 hours of non-payment Nova Games will contact you to remind you payment on the item has to be made.
(4.3) Once you place an order with Nova Games you will then be re-directed to PayPal who will process your payment. PayPal is a safer confidential way for you to shop none of your personal payment or bank details will be possessed by Nova Games. This is why Nova Games are not held responsible for the security of your debit/credit card details. However, we do use secure links during transaction to help protect your personal details.
(4.4) You do not need to posses a PayPal account to make a payment to us at Nova Games. PayPal only process our transactions.
(4.5) All payment for Pre-Orders will be dealt with the same as normal orders; all payments must be made within 24 hours of placing an order to ensure you will receive the item on time. The same Terms and Conditions apply to Pre-Order items as any Non-Payment within 24hours will result in a cancellation of your order.
5. Delivery status
(5.1) We at Nova Games aim to keep customer informed about their orders, we aim to answer all enquires about orders within 24 hours and we aim to keep you informed about you order by changing the delivery status within 24 hours of placing your order.
Nova Games Delivery status is as follows:
(5.2) Confirmed – This means that the payment from you the customer has been made and the order has been confirmed. This will mean we at Nova Games will now take appropriate further action to complete the order. Orders can be cancelled and refunded at this point; orders can also be cancelled at this point if items have an obvious pricing error.
(5.3) Pending- This means you have placed an order but you have not made a payment to us, you will need to make the payment before the order status will become confirmed and before we can move to the next stage of processing your order.
(5.4) Shipped - This means your order has be packaged and shipped to the address which you stated at the time of purchase, if you live within the UK this should arrive between 1-5 working days. Outside the UK can take a lot longer (up to 20 working days depending on the location) and may cost extra which will be charged at the time of purchase.
(5.5) Cancelled- This means your order has been cancelled, this is either because you have requested your order to be cancelled or we have cancelled your order due to certain reasons state in the Terms and Conditions. (1.5) (10.1) (10.2)
(5.6) Refunded- This mean the amount which you paid for an order had been refunded to you, this is usually because an order has been cancelled; this may also be because we no longer supply an item.
(5.7) Awaiting stock- This is when an order has been confirmed but we are awaiting stock of this/these item(s), once these items are back in stock Nova Games will automatically change the status of the order to shipped and the item will be shipped to you the same working day it arrives with us. However, Nova Games cannot guarantee a date in which items will be back in stock due to the nature of postal system and due to the availability from the supplier.
(5.8) Pre-Order- This is when an order has been confirmed but you have to wait until the release date of an item before it can be shipped to you. One day before the actual release date we aim to ship the item to you so it should arrive for the release date, however we cannot guarantee the item will be shipped to you one day before the release date or that the item will arrive on the release date to many factors. Once the item is in stock we aim to post it to you the same Woking day.
6. Delivery
(6.1) Nova Games pride themselves in offering all United Kingdom Customers a super fast dispatch service which is dispatched the same working day if the item it ordered before 4pm (Excludes pre orders). This is standard 1st or 2nd class delivery which should arrive within 1-5 working days depending on which class the item has been sent.
(6.2) Items with a value over £50 may be upgraded free of charge to first class recorded delivery so both Nova Games and the customer can have peace of mind knowing their goods are safe. However, Nova Games is under no obligation to upgrade the postage to first class recorded if the items ordered are over £50.
(6.3) Nova Games respect the customer’s interest and understand that customers may be frustrated if their items do not arrive on time, however, Nova Games cannot guarantee that the item will arrive on time as factors such as the current postages system and availability of stock may mean there is a delay in the order being sent out. Nova games, does update customers on the availability of stock and will inform customers if there could be a delay with their order.
(6.4) Although Nova Games send items 1st or 2nd class delivery which should take between 1-5 working days we cannot guarantee that the items will be received within this time frame. If your item has not been received within this time frame please wait for at least 7-10 working days before contacting us as delays may have occurred due to unknown circumstances. When contacting Nova games, please include your order number and your contact details so we can track your order and resolve the issue as soon as possible.
(6.5) Nova games allow customer to choose which address the items should be dispatched to, we rely on the information which you provide us and if any of the information which you have submitted is incorrect, we do not accept any responsibility if the item is sent to the wrong address. Nova Games will only use and send the item to the address which you the customer have provided to us during the Billing and Checkout process. If the address entered is incorrect we cannot guarantee the items will reach the desired destination and we will assume no responsibility for the goods.
(6.6) Nova games will dispatch any pre-order items on the day before the release date this should ensure the items will arrive for the release date, however, Nova games cannot guarantee that the items will be received on the release date. We do try our best at Nova Games to ensure the pre-orders arrive on time but we cannot ensure the item will be despatched the date before due to the availability of the pre-order items.
7. Pre-Orders
(7.1) Pre-Order items can be bought from our online store, the same terms and conditions for all other orders also apply to Pre-Order Items. For example, If payment is not received within 24 hours orders will be cancelled.
(7.2) All payments for pre-order items must be made 4 working days in advance to the release date of the Pre-Order item. Nova Games are under no obligation to reserve stock for customers who do not make the payment at least 4 working days before the release date of the Pre-Order item.
(7.3) Any customer had the right to cancel you order, however, any cancelation which you want to make on Pre-Order items must be made at least 2 working days before the release date of the item. If you do not cancel the order within 2 working days of the release date then the item will automatically be posted to you and you will have to follow the returns procedure in order to receive a refund for the item. (9.1)-(9.5)
(7.4) Nova Games can not guarantee that the date which the Pre-Order will be released will be accurate; this is because the Pre-Order release date is subject to change due to the manufacture. However, we will try our best to keep customers updated and any customers who have bought a Pre-Order item will be informed of the change in the release date to avoid any confusion with their order.
(7.5) At Nova Game we endeavour to have all pre-order items dispatched to you, to arrive on the release date. However, Nova Games do not take any responsibility if an order does not arrive within this time frame.
8. Pricing (8.1) We at Nova Games aim to offer the best prices possible to all of our customers, as we believe in values for money. However, we cannot guarantee that the prices which are displayed on our website are always correct. If an item is misprices we will aim to have any pricing errors fixed within 24 hours however, some pricing errors can go unnoticed which could lead to a cancelation in your order or Nova Games team needing to make amendments to your order and the pricing.
(8.2) Nova Games reserve the right to change the price of any of the items which are displayed on the website without prior notice to any customer. We cannot guarantee that the price for any item is fixed and we cannot guarantee that the price is long term.
(8.3) If an item has been purchased and paid for on a certain day and the price of the item changes then the price which you have already paid and purchased the item for is fixed and guaranteed this includes pre-order items. For example, if an item is £15 on the 10th of May and an individual purchases and pays for the item but on the 11th of May the price is £7.99 there will be no discount issued to the buyer on the 10th of may and they will still pay the full amount of £10, however, if the item is purchased on or after the 11th of May the customer will only pay the £7.99.
9. Returns
(9.1) If you feel you want to return an item for any reasons you can along as it meets the terms and conditions in our returns policy which are stated below.
(9.2) You must examine your goods immediately on delivery and email us within 24 hours of receipt to inform us of a return, if you do not email us within 24 hours of delivery we cannot guarantee that your return will be accepted. When emailing us of the return you must state why you are returning the item, you must also return the item unopened and undamaged in its original packaging.
(9.3) Nova games are under no obligation to accept your return if you have damaged the item or if you have opened the item from its original packaging. If the item has been damaged or is defective please email us straight away with the details so we can assess whether or not the item will qualify for returns.
(9.4) If an item has been obviously mis-described we will then accept returns but be sure to fully read the description of items to ensure you want the item before placing an order as will avoid any unnecessary confusion to you the customer. We are under no obligation to accept returns if you have mis-understood the description of the item.
(9.5) Return of items will only be accepted if they have not been removed from their original packaging, if they are sent back to us at Nova Games within 3 Working days since delivery and if you have notified us of the return before it was sent and we have confirmed that the item may be returned. Any items which are part of a bundle deal must be returned in full even if only on of the items in the bundle deal is unwanted. (11.3)
10. Cancellation
You have the right to cancel your order before it has been dispatched and receive a full refund.
(10.1) If your order consists of non Pre-Order items Nova Games Need notification of cancelation before 3pm on the same working day, this will mean the item will not be sent to you and you will not need to follow a returns procedure. If payment had already been made Nova Games will issue a refund the same working day once a cancellation has been made, However, Nova Games Can Not guarantee that the refund will be issued the same working day.
(10.2) If the cancellation has been requested after the item has been dispatched to you then the Nova Games team are under no obligation to accept the cancellation and you will have to notify us and follow the returns procedure in order to receive a refund for the item. (9.1)-(9.5)
By cancelling or returning an item you do not affect your statutory rights
11. Special offers
(11.1) Nova Games aim to offer our customers the best prices as we offer items below the Recommended Retail Prices in our special offers section. We aim to offer a wide range of special offers to customers as we believe in value for money. Despite our best efforts special offers can only be bought for a limited period of time, however, if items are to be removed from the special offers section there will be and ending date for the special offers stated to ensure customers can take full advantage of the limited period to buy the items at a discounted price.
(11.2) At Nova Games we have the right to change the price of any of the items including items under the special offers category without prior notification. We cannot guarantee that all the items in the special offers section will have a price which in under the RRP, however, we try to guarantee that all the items in the special offers section are value for the price which they are offered at.
(11.3) At Nova Games we offer a range of bundle offers, these consist of a variety of items which we cannot guarantee will meet the customers’ expectations, for example, the bundle may contain an item which the customer does not desire. It is the customer full responsibility to read the description of the bundle deal to ensure they want all the items which it contains before they proceed with the transaction to avoid any disappointment or confusion. The customer cannot request that any items in the bundle deal be exchanged for another item as this would mean the price for the bundle deal could increase.
(11.4) Items which do not meet the customers’ expectations can be returned if they meet the returns policy, however, items which have been bought as part of a bundle deal cannot be returned separately, all the items which consist in the bundle deal must be returned and meet the returns policy in order to receive a full refund, items sent back separately from a bundle pack will be sent back to you the customer unless the full bundle is returned. (9.1)-(9.5)
12. Competitions
(12.1) Nova Games advertise all their competitions on facebook and in the News / Release calendar and give each customer an equal chance of winning the competition. Each person who is entered into the competition will have to adhere to the competitions rules. For example, if the entry requirement is that an individual registers with Nova Games then only individuals who register for a Nova Games account and adhere to the Terms and Conditions of the competition will be selected for our randomised draw. Nova Games are under no obligation to consider individuals for the randomised prize draw if they do not adhere to the competitions rules or terms or conditions of the prize draw.
(12.2) Only one entry per customer will be accepted, this is to ensure that each person had an equal chance in the draw. The entrants must be 18 and over. Entrance from individuals which are under the age of 18 will be discarded. Nova Games reserve the right to eliminate any competitors from the competition if they break the rules of the competitions or do not meet the requirement needed to enter into the competition. Nova games will discard any duplicate entries or count duplicate entries as 1 entry to ensure there is only one entry per customer.
(12.3) The competitions can be entered by anyone, however, Nova Games reserve the right to withdraw an entry from the competition if any individual has broken the rules of the competition or has tried to increase their chance of winning the competition. For example, if an individual has entered several entries into the competition to increase their chance of winning.
(12.4) Nova Games accepts no responsibility for the prize draw winner as the winner is selected at random so it is a completely fair draw to each of the competitors. Each individual had an equal chance at winning. Once the competition has closed Nova Games will have an independent individual select a winner at random.
(12.5) Competition winners will be informed within 24 hours after they have been chosen, the winner will have 2 weeks to claim their prize and if they do not claim the prize within 2 week period the prize will automatically be donated to a charity. If the competition requirements meant the Nova Games already have your registered address we will then send the prize free delivery to the address which you have registered with us. Nova Games are under no obligation to run competitions and are under no obligation to inform individuals of any competitions which they are currently running.
13. Gift Vouchers
(13.1) Gift vouchers which are valid for use on the Nova Games website can ONLY be bought by contacting the Nova Games team and requesting a Gift voucher; Nova Games will only accept these valid gift vouchers and is under no obligation to accept any other gift voucher.
(13.2) Nova Games gift vouchers can only be redeemed on the Nova Games website and will be accepted as part or full payment of goods, When items are paid for using a gift voucher , Nova Games reserve the right to refuse a refund . However, we will aim to issue an exchange of items along as the item adheres to the returns policy. (9.1)-(9.5)
(13.3) No refunds will be issued for gift vouchers. Nova Games reserve the right to revoke any gift vouchers if they are being misused for example, you try to use the gift voucher on another website or you try to redeem the gift voucher twice.
(13.4) A Nova Games Gift voucher is only valid for 12 months from the date of purchase. We are under no obligation to redeem or accept any voucher codes which are expired. If you want the validity of the gift voucher to be extended please use your gift voucher code to buy another gift voucher of the same value, this will mean you will receive a new gift voucher which is valid for 12 months of date of purchase.
14. Discounts /Discount Codes
(14.1) Nova Games are under no obligation to offer any discounts or discount codes to any customers, however if a discount is issued only one discount or discount code can be used per transaction. Nova Games reserve the right to remove discounts and discount codes without prior notification.
(14.2) Discount codes are only valid for a limited period of time and discount codes can not be used after their expiry date. Nova Games are under no obligation to issue discounts after the discount period or discount code has exceeded it expiry date.
(14.3) To qualify for a discount you must meet the terms and conditions which are specified about discount, for example, if the minimum spend to qualify for a discount code is £10 then customers must spend more than £10 in one transaction in order to qualify for a discount.
15. Liability
(15.1) Here at Nova Games we aim to make the customer experience as pleasant and smooth as possible, however, please bear in mind that you use our website and our service which we provide at Nova Games at your own risk .
(15.2) Nova Games make no warranties that our website and our service will meet your requirements and that the service and our website will be uninterrupted.
(15.3) We do not make any warranty that the quality of any of the items purchased or obtained by you thought Nova Games will meet your expectations.
(15.4) Nova Games does not accept liability for any errors and omissions and reserves the right to change information, prices, specifications and descriptions of listed goods, products and services.
(15.5) Nova Games will do its best to correct errors and omissions as quickly as practicable after being notified of them.
16. Definitions
Recommended Retail Prices (RRP) - These are the prices which the manufacture recommends we sell the items at
Customer – Is the person who purchases the product from Nova Games
Consumer- The person who uses the product which was bought
Pre-Order- An item which is available for sale but it has not been released yet, this item will be sent to the customer on the actual release date.
